Phd in PRIVATE AUTONOMY BUSINESS, WORK AND
PROTECTION OF RIGHTS IN EUROPEAN AND INTERNATIONAL PERSPECTIVE

The program for the first year of the course consists of a series of lectures, seminars, workshops on the issues related to the different curricula as to allow Ph.D. candidates to focus on the chosen subjects under the supervision of the Scientic board and of external members. The activities may be specic to individual curricula or general to all the candidates. Significance will also be given to individual or group research activities, as well as to any related publication – which will be assessed taking into account its level of insight. Participation in public competitions, study trips, internships, and conferences will also subject to evaluation. As far as foreign Ph.D. candidates or Ph.D. candidates without scholarship are concerned, the assessment may not strictly follow the aforementioned scheme, but may be submitted to the Board considering a detailed report of the research activities carried out.
 
The Advanced Institutional Course 1 (Principles and methods of scientific research) is divided into several lectures which will focus on topics related to the various curricula. Online seminars, conferences and lectiones magistrales on the issues of most significant interest for the different sectors will also be organized. The classes of the Course, common to all Ph.D. candidates, are held online or in the Faculty from November to May, every Friday from 9.00 a.m. to 6.00 p.m. and Saturday morning from 9.00 a.m. to 1.00 p.m.
 
Labour Law

As part of the Advanced Institutional Course, the curriculum will address the following areas: collective bargaining; the notion of employment; the trade union freedom and the trade union activity; the economic rights of the employee; employment in the public sector.

Tax Law

As part of the Advanced Institutional Course, the curriculum will address the following areas: tax power, the new regulation of tax credit.

Commercial, Company, Financial and Competition law

As part of the Advanced Institutional Course, the curriculum will address the following areas: the company, in all its dimensions and organizational forms; the purpose of the company; the company and the purpose of profit; corporate social responsibility; the company and environmental protection; the regulation of intellectual property; the new procedures for early intervention and management of the business crisis.

Comparative private Law

As part of the institutional course, the curriculum will address the following thematic areas: the objects of legal comparison and the critique of legal positivism; systemology and geopolitics; the models of capitalism; the Western legal tradition; the comparison between common law and civil law; the legal change; the new comparative economy; the methods of comparison.
The lecture program will be integrated on the basis of suggestions from doctoral students and in relation to the presence of foreign guests in the context of international agreements in progress.
PhD students will participate in two monthly meetings during which they will report the progress of the thesis work, will set up research on other topics with the aim of publication in legal journals and will critically analyze fundamental texts relating to their research. PhD students will also be encouraged to participate with interventions in seminars and conferences of general interest  for the subject or specific interest related to their research path.

Civil law and History of European Law

As part of the advanced institutional course, the curriculum will address the following thematic areas: contract and fundamental rights; European integration process and impact on relations between private individuals and the European system; private law and war legislation; international copyright protection.

Civil procedure
 
As part of the institutional course, the curriculum will address the following thematic areas: the sixth book of the civil code: bridge between substantive and procedural law; the civil judgment: object, effect, operation in new processes; autonomous and heteronomous methods of dispute resolution; civil jurisdiction and its (internal) borders.
In the second semester, prof. Bruno Capponi, former full professor of civil procedural law, will hold a cycle of five lessons, for all PhDstudents, on the subject of executive proceedings.

PhD students take part in the periodic meetings of the Journals Judicium and Rassegna dell'Esecuzione Forzata (coordinated by Professors Bruno Sassani and Bruno Capponi) and of the Osservatorio della giurisprudenza di Cassazione della Rivista di diritto processuale (coordinated by Prof. Giuseppe Ruffini), meetings that have also preparatory purposes in view of the drafting of writings (note a sentenza and articles) by the PhD students.

PhD candidates will submit to the Board a proposal of dissertation, selecting the theme among the issues of scientific interest covered and dealt throughout the year. They will be supervised by the members of the Board and by the scholars involved in the training activities.

The research work carried out by the candidates will be subject to periodic checking – they will present detailed reports in which they will illustrate to the Board the progress of their studies and the outcomes achieved.

Taking into consideration the program chosen for the first year and the issues covered by each individual research, Ph.D. candidates will be requested to give an effective contribution to carry out the seminar activity.
Candidates will also be allowed to personalize their path of studies, proposing to the Board activities of their specific interest. The development of each candidate can be better evaluated considering any additional paper presented.
The Advanced Institutional Course 2 (Regulatory sources in the age of globalization) is divided into several lectures which will focus on topics related to the different curricula. Comparative private law

As part of the institutional course, the curriculum will address the following thematic areas: comparison in the field of commercial law and corporate law; the relationship between the prerogatives of sovereignty and the influences of the international order; the use of comparison by international courts.

As part of the institutional course, the curriculum will address the following thematic areas: the European judicial area; the judicial request and proof; the plurality of parties in first instance judgments; the connection.

Throughout the second year, the candidate will focus his attention on bibliographic research and on the case law, collecting the materials in order to start drafting the final dissertation constantly supervised by the tutor and the Board. Progress of the research will periodically be discussed with the Board, and the Ph.D. candidate will be asked to submit written reports and/or parts of the thesis.
In view of the number of international agreements reached with European and international universities, second-year candidates will be encouraged to spend periods of study and research abroad, to deepen their specific studies and possibly attend summer schools, conferences, and seminars.
 

The candidate will be called to report periodically to the Scientific Board upon the progress of the research work and will be asked to start writing the final dissertation.

Access to the final exam will be subject to a discussion of the dissertation with the Board – which will assess the level of insight of the research, its quality and its originality. The Board will eventually approve a review of the dissertation, which will be submitted for the final evaluation, together with the dissertation itself and with individual reports of the supervisors.

For the admission to the final exam, Ph.D. candidates regularly enrolled in the third year of the course must submit their research work to the Board before the deadline indicated by the latter in compliance with the Academic calendar. The final paper will subsequently be forwarded to external examiners, who will express their comments. In the event of a positive outcome, the Ph.D. candidates will be admitted to the final discussion, in compliance with the procedure set out in the University's rules regarding the PhDs.
