Educational goals and objectives

PRIVATE AUTONOMY BUSINESS, WORK AND PROTECTION OF RIGHTS IN EUROPEAN AND INTERNATIONAL PERSPECTIVE
The PhD course is articulated in six curricula:

12/GIUR-04 Labour Law. The course is aimed at a study of the regulations on employment relationships, including aspects related to trade union law, social security, and occupational health and safety at work. The analysis also considers the transformations brought about by new technologies at the level of national sources, European legislation, and comparative experiences.

12/GIUR-08 Tax Law. The curriculum is carrying into the principle of transparency, impartiality, effectivity and efficiency. The auspicated parity conditions between administration and taxpayers are still far but the new legislation, among the Statute of the Tax Payer, make a different behaviour of these relations impressed to a major collaboration.

12/GIUR-02 - 12/GIUR-03 Commercial law and markets’ regulation. The areas of research are as follows: (a) business enteprise; (b) business contracts; (c) markets’ regulation and competition law; (d) public supervision of private companies; (e) intellectual property; (f) representation and circulation of movable wealth; (g) corporate governance; (h) insolvency law.

12/GIUR-11 Comparative Private Law. The program is designed to develop a solid theoretical foundation in the comparative analysis of legal systems, with particular attention to methodological approaches and the dynamics of the circulation of normative models in the European and international contexts, enabling to acquire the necessary critical skills to conduct research in this field.

12/GIUR-01 - 12/GIUR-16 Civil Law and History of European Law: The purpose is to prepare PhD students for scientific research in Civil Law and History of European Law. The training programme includes: (i) the study of European private law in its historical evolution, through the in-depth study of the main institutions in a diachronic perspective; (ii) the rights and interests protected by the rules and the so-called fundamental rights; (iii) the process of European integration; (iv) the study of convergence aspects in the evolution of European legal systems.

12/GIUR-12 The course in civil procedural law focuses on the matters, in the innovations of the civil procedure code, special legislation, the procedural profiles of bankruptcy, alternative dispute resolution. The aim is to deepen the cultural knowledge on a theoretical and applicative profiles, as well as to develop research skills.

Admission Procedure

Written examination The candidates will be called upon to elaborate on one or more topics of relevance in the field of the chosen curriculum. To attend the test candidates must present a valid identification document and are invited to arrive in the class indicated at the Atrium of the Faculty of Law to complete the identification procedures. The written exam consists in carrying out a theme in the chosen subject (different according to the curriculum chosen by any candidate)extracted from three tracks established by the Commission for each curriculum. Criteria for the evaluation of written exam: grammatical correctness and syntax; clarity; complete, coherent and orderly development of argumentation; problematic analysis of the arguments; knowledge of the doctrinal and jurisprudential debate; historical and comparative framework. For the conduct of the written examination, candidates will have up to four hours after the dictation of theme. The duration will be announced by the Commission on the day of the test, during which it will be possible to consult the codes, dictionaries and texts of law not commented. Codes and laws not commented are codes and texts without practice, circulars, doctrinal and jurisprudential references, notes, reviews, comparisons and annotations, also by hand. During the written test, on pain of exclusion from the competition: candidates shall only use a black ink pen;- they shall not insert on the manuscript any sign of recognition (other colour pen, pencil, use of whiteout, signing etc.); they shall not keep bags or backpacks, books or notes, paper, cell phones and other electronic devices (including devices able to send photographs and pictures or any kind of portable personal computers able to connect with the outside of the classrooms via wireless or by telephone network); they shall not talk with other candidates, but only with the members of the Commission. They are admitted to the oral examination the candidates who have passed the written exam with a minimum score of 40/60 points and who have reached sufficiency to every criterion of evaluation.

Oral interview To attend the oral exam the candidates must present a valid identification document. The oral exam is an exam on Civil procedural law or Labour law or Tax law or Commercial law of economy or Private Comparative Law or Civil Law and History of European Law. During the test it is also verified the knowledge and command of the chosen foreign language. Criteria for assessment of the oral examination: aptitude for research and study motivation; argumentative capacity and problematic approach; good knowledge of curriculum subjects; correctness and clarity. The oral exam is passed if the candidate gets a minimum score of 40/60 points and reaches sufficiency to every criterion of evaluation

Qualifications assessment The evaluation of qualifications is accessed only after passing the oral test. For the purpose of the final ranking, a maximum of 15 points (of which a maximum of 5 for degree grade, a maximum of 8 for publications, and a maximum of 2 for research experience) may be awarded on the basis of titles.
