Educational goals and objectives

PUBLIC LAW
The Public Law PhD Program is articulated in five different curricula: Constitutional Law, General Public Law and Comparative Public Law; Administrative law; Criminal law and procedure; International and European Union Law, and Law and Economics. The curriculum in Constitutional Law, General Public Law and Comparative Public Law deals with the classic issues of the disciplines, as defined by Italian and European public law doctrine. All the related topics to general, sectorial, state, and supranational legal systems; sources of law; fundamental rights, also within the multilevel European dimension; dynamics of territorial decentralization; constitutional guarantees and constitutional justice; government, also referred as relations among the supreme state institutions, local authorities and European Union Institutions. The curriculum in Administrative Law explores the transformation processes of the organization and functioning of public administrations and rule of law related issues as principle of legality and judicial protection of fundamental rights against public administration acts. The research topics move from the study of international administrations, in particular its coordination with national administrations, the analysis of specific issues such as food safety, environmental protection and competition. The curriculum in Criminal Law and Procedure proposes a didactic-training program in an attentive dimension oriented by an interdisciplinary framework of the criminal sciences, with the intention to stimulating doctoral students to a greater openness of their research, taking into account the interactions and influences with other disciplines such as prison law, criminology, forensic medicine and forensic psychology. The curriculum in Law and Economics promotes interdisciplinary legal and economic research activities, in order to improve the understanding of reasoning and effects of regulatory legal intervention, choices related to institutional arrangements and questions connected to the enforcement of legal regulation. The law is therefore therefore taken as an object of study, characterized by a set of behavioral incentives/disincentives, to be analyzed and studied through the use of economic instruments. The curriculum in International and European Union Law intends to offer advanced training in the field of transnational legal phenomena and its relationships with international law and European integration Law. PhD students will have to lead seminars and thematic debates in order to develop analytical and critical skills; activities that will be carried out in constant interaction with the other curricula of the phd program in order to improve the methodological perspectives of interdisciplinary nature.

Admission Procedure

Presentation of a research project The research project will be evaluated according to the following assessment grid:
Research project (max 20 points)
Candidates must submit a research project that they intend to carry out during the three-year PhD program, which will be evaluated by the Selection Committee for admission to the written test. The project must have a minimum length of 25,000 characters and a maximum of 35,000 characters (including spaces, punctuation and bibliography), written in Italian and including an index and bibliography (with bibliographic references also international), must indicate the reference subject in the course curricula doctoral degree (administrative law; constitutional law, general public Law and public comparative Law; criminal law and procedure; international and european law; law and economics). The evaluation of the research project is carried out according to the following parameters: (i) Relevance of the research project. The project is required to account for the scientific elaboration on the chosen research topic, highlighting the main problems that it poses. Particular attention is required regarding comparative law and the possible supranational and international relevance of the research topic. (ii) Structuring of the research project. The structure of the project must unfold according to internally coherent lines and linked arguments, also through the illustration of the chosen methodological approach. Structuring in chapters or even in paragraphs is not strictly required in the presentation of the project. Projects that do not meet the minimum length of 25,000 characters and a maximum of 35,000 characters (including spaces, punctuation and bibliography) will be excluded. Under penalty of exclusion, the name of the candidate or other identifying marks (like background images or watermarks) must not appear on the title page, but only the university registration number, the curriculum for which you want to compete, the title of the project, strictly in PDF version, under penalty of exclusion.

Candidates who have obtained a minimum grade of 14/20 are admitted to the written test.

Written examination The written test will be evaluated according to the following assessment grid:
Written test (max 60 points)
The written test consists of the development of a theme of: 1. Administrative Law; 2. Constitutional Law, General Public Law and Public Comparative Law; 3. Criminal Law and Procedure; 4. International and European Law; 5. Law and Economics, extracted from three traces prepared by the Commission for each curriculum. For the curriculum in Constitutional Law, General Public Law and Public Comparative Law, the topics of the test will have as their object themes that can also be developed from a comparative perspective. For the curriculum of Law and Criminal Procedure, the topics of the exam may be about, at the discretion of the Commission, or an argument - to be extracted from a triad - between Criminal Law and the Criminal Procedure or a theme chosen by the candidate - also extracted from a three - of Criminal Law or Criminal Procedure. Normally the discussion is of a theoretical nature (not as practical as proof of qualification for the profession) and can also be inspired by relevant case law. With regard to the International Law and European Union Law curriculum, two separate lists of three topics for each subject will be chosen by the board of examiners. Within each of the lists, one topic will be drawn by candidates and will be the subject of the written part of the test. Test language: ITALIAN. The evaluation criteria of the written test are the following: grammatical and syntactic correctness; expository clarity; completeness of the treatment; consistent and orderly argumentative development; problematic analysis of the topics; knowledge of the doctrinal debate and the main jurisprudential addresses; historical-comparative framework.

Candidates who have obtained a minimum grade of 40/60 are admitted to the oral exam.

Oral interview The oral exam will be evaluated according to the following assessment grid:
Oral exam (max 40 points)
Candidates who pass the written test will submit a discussion to the Selection Committee focusing on the research project they intend to carry out in the doctorate. Test language: ITALIAN.
The evaluation criteria for the oral exam are the following: aptitude for research and motivation to study; argumentative capacity and problematic approach; good knowledge of curricular subjects; fairness and clarity of exposition. Moreover, during the test, the knowledge and mastery of the English language is ascertained both with the reading and translation of an English text, and with the possible exposure in English of the research project.

The oral examination is considered passed if the candidate obtains a score of at least 26/40.

more info The PhD course in Public Law is strongly oriented towards internationalization and comparison with different legal and cultural systems. To this end, PhD students will be required, except for specific motivated situations that may be assessed, where necessary, by the Scientific Board, to spend a period of at least 3 months during the three-year program - even non-continuously - in a foreign university institution or equivalent internationally recognized research center, which will be chosen based on their research topic and in agreement with their tutor.

Progetto di ricerca (max 20 punti) I candidati devono presentare un progetto della ricerca che intendono svolgere nel triennio del dottorato, che sarà oggetto di valutazione da parte della Commissione giudicatrice ai fini dell’ammissione alla prova scritta. Il progetto deve essere della lunghezza minima di 25.000 battute e massima di 35.000 battute (spazi, punteggiatura, note e bibliografia inclusi), redatto in lingua italiana e comprensivo di indice e bibliografia (con indicazioni bibliografiche anche internazionali); deve indicare la materia di riferimento nell’ambito dei curricula del Corso di dottorato (diritto amministrativo; diritto costituzionale, diritto pubblico generale e diritto pubblico comparato; diritto e procedura penale; diritto internazionale ed europeo; Law and Econimics). La valutazione del progetto di ricerca è compiuta in base ai seguenti parametri: (i) Rilevanza del progetto di ricerca. Il progetto è tenuto a dare conto dell’elaborazione scientifica sul tema di ricerca prescelto, mettendo in luce le principali problematiche che esso pone. Particolare attenzione è richiesta riguardo al diritto comparato e all’eventuale rilevanza sovranazionale e internazionale del tema di ricerca. (ii) Strutturazione del progetto di ricerca. La struttura del progetto deve dispiegarsi secondo linee internamente coerenti e argomentazioni fra loro concatenate, anche tramite l’illustrazione della impostazione metodologica prescelta. La strutturazione in capitoli o anche solo in paragrafi non è strettamente richiesta nella presentazione del progetto. I progetti che non rispettano la lunghezza minima di 25.000 battute e massima di 35.000 battute (spazi, punteggiatura, note e bibliografia inclusi) verranno esclusi. A pena di esclusione, sul frontespizio del progetto non dovranno essere presenti le generalità del candidato o altri segni di riconoscimento (come immagini, sfondi o filigrane), ma solo ed unicamente il numero di matricola, il curriculum per il quale si vuole concorrere, il titolo del progetto e questo dovrà essere caricato tassativamente in versione PDF, pena l'esclusione. Sono ammessi alla prova scritta i candidati che hanno conseguito almeno 14 punti nella valutazione complessiva del progetto di ricerca.

Prova Scritta (max 60 punti) La prova scritta consiste nello svolgimento di un tema in una delle seguenti aree: 1. Diritto Amministrativo; 2. Diritto costituzionale, diritto pubblico generale e diritto pubblico comparato; 3. Diritto e procedura penale; 4. Diritto internazionale e dell’unione europea; 5. Law and Economics, estratto fra tre tracce predisposte dalla Commissione per ciascun curriculum. Per il curriculum di Diritto costituzionale, diritto pubblico generale e diritto pubblico comparato, gli argomenti della prova avranno ad oggetto tematiche sucettibili di svolgimento anche in un’ottica comparata. Per il curriculum di Diritto e procedura penale, gli argomenti della prova potranno avere ad oggetto, a discrezione della Commissione, o un argomento – da estrarsi da una terna – a cavallo tra il Diritto penale e la Procedura penale o un tema, a scelta del candidato – estratto anch'esso da una terna –, di Diritto penale o di Procedura penale. Normalmente la trattazione è di natura teorica (non pratica come per le prove di abilitazione alla professione) e può prendere spunto anche da indirizzi giurisprudenziali di rilievo. Per il curriculum di Diritto internazionale e dell'Unione europea, verranno presentate ai candidati due distinte terne, corrispondenti ai due settori scientifico disciplinari, tra cui verranno estratte le due tracce oggetto della prova scritta. Lingua della prova: ITALIANO.
