Thesis title: La regolazione pubblica delle piattaforme digitali tra democrazia economica e innovazione
The research aims to analyze models of public regulation of digital platforms, with particular reference to the solutions adopted by the European Union in recent years, focusing on the issue of the form of regulation. The choices made by public regulators play a fundamental role in ensuring the successful functioning of digital markets and protecting the rights and interests involved, with a view to promoting innovation and enjoying its benefits, but also to maintaining a form of economic democracy, which is the basis for the legitimacy of the market economy. In this context, the analysis starts from a reconstruction of the main characteristics of digital markets and digital platforms, considering the latter in their dual role as economic operators and ‘private powers’, and then proceeds to reconstruct the evolution of regulatory models in the field over time, focusing on the most recent European solutions and, in particular, on the analysis of the Digital Markets Act (Regulation (EU) 2022/1925) . In light of the analysis carried out, the research will finally focus on issues relating to the extent and forms of regulation, investigating various regulatory instruments and models in order to identify those most appropriate to the concerned field.
