Research: Fictio vel persona: genealogy of a mechanismA newly developed tendency seems to form in legal and political theory and practice by extending the category of subjects of rights, if not that one of persons, to non-human animals and even to other entities such as forests, rivers, among others. The aim of my research is to examine, under a philosophical light, the mechanism used by legal orders to perform such an extension of personhood to non-human entities: fiction, i.e., the fiction of personhood. Furthermore, I intend to examine the role that fictions play in legal and political orders, using personhood as the threshold via which it is possible to see and grasp the meaning of the presence of these artifices in the play of legal and political power, being at the same time a mechanism of apprehension of the outside of the political order, and the threshold by which the conception of a new idea of order is possible.
