The Italian legal system regards the right to religious freedom as a subjective public right, not limiting its exercise to the individual’s ability to make use of it but assigning state institutions the responsibility to ensure its protection.
The State must guarantee and safeguard this right for all individuals within its territory, establishing the necessary conditions for its full exercise.
The right to religious freedom must be ensured in all circumstances, including for those detained under special prison regimes, characterized by extreme restrictions on personal freedom.
This thesis examines how this right is protected in such situations, highlighting its limitations and challenges, particularly in consideration of the specific individuals subject to these regimes.
