| descrizione: | CURRICULUM IN DIRITTO ROMANO E DIRITTI DELL'ANTICHITÀ
obiettivo fondamentale è promuovere ricerche che riguardino il diritto romano nel contesto storico delle società antiche. Campi rilevanti di indagine e di riflessione, oltre ad un'imprescindibile considerazione sulla ratio del diritto romano, sono il diritto giurisprudenziale, l’analisi e la risoluzione dei casi controversi (il diritto romano come case law), la costruzione degli schemi teorici e la definizione delle idealità che muovono i giuristi ed ispirano le loro scelte.
CURRICULUM IN TEORIA DEGLI ORDINAMENTI:
Il curriculum di Teoria degli ordinamenti persegue i propri obiettivi in una prospettiva peculiare di multidisciplinarietà ed è strutturato secondo due itinerari autonomi e specifici, profondamente collegati agli altri curricula del dottorato in un orizzonte teorico che concerne il riferimento sia alla tematica ordinamentale che alle questioni di giustizia: un itinerario è connesso più strettamente alla filosofia del diritto, alla teoria generale del diritto, all'ermeneutica giuridica secondo riflessioni che investono i diritti dell'essere umano, in un contesto interculturale significativamente marcato dall'attuale potere degli algoritmi; l'altro attiene ai problemi propri del diritto canonico ed ecclesiastico, secondo una Weltanschauung sia teorica che più strettamente collegata al diritto positivo.
CURRICULUM IN DIRITTO DEI CONTRATTI ED ECONOMIA D'IMPRESA: Le aree tematiche trattate nell'ambito del diritto privato del mercato hanno lo scopo di contribuire al rafforzamento dell'integrazione nazionale e internazionale dei sistemi universitari tramite la promozione di iniziative in campo culturale, scientifico e didattico attraverso lo studio delle scienze giuridiche ed economiche, anche nell'ambito delle istituzioni giuridiche e politiche europee; il tutto perseguendo la finalità mediata della costruzione delle basi per la formazione di uno spazio giuridico europeo e per il consolidamento e la perfetta integrazione all'interno del mercato comune. |

the fundamental objective is to promote research concerning Roman law in the historical context of ancient societies. Relevant fields of investigation and reflection, as well as an essential consideration on the rationale of Roman law, are jurisprudential law, the analysis and resolution of controversial cases (Roman law as case law), the construction of theoretical schemes and the definition of the ideals that move jurists and inspire their choices.
CURRICULUM IN ORDER THEORY:
The Theory of Legal Systems curriculum pursues its objectives in a peculiar multidisciplinary perspective and is structured according to two autonomous and specific itineraries, deeply connected to the other curricula of the doctorate in a theoretical horizon that concerns the reference both to the legal system theme and to the questions of justice: an itinerary is more closely connected to the philosophy of law, to the general theory of law, to legal hermeneutics according to reflections that invest the rights of the human being, in an intercultural context they should be marked by the current power of algorithms; the other pertains to the problems of canon and ecclesiastical law, according to a Weltanschauung that is both theoretical and more closely connected to positive law.
CURRICULUM IN CONTRACT LAW AND BUSINESS ECONOMICS: The thematic areas dealt with in the field of private market law aim to contribute to strengthening the national and international integration of university systems through the promotion of initiatives in the cultural, scientific and didactic through the study of legal and economic sciences, also in the context of European legal and political institutions; all pursuing the mediated aim of building the foundations for the formation of a European juridical area and for the consolidation and perfect integration within the common market. |
